If you have a properly filed child support order you will be paid first before he gets any money. If the amount owed to you is more than he gets, he will get nothing.
If you have a child support order thru the courts stating that you get his tax returns then yes you will. The amount owed to you will be given to you first before he gets anything.
If your State has set up with Financial Management Services to offset his refund, and his refund is intercepted, you would need to ask you Division Of Child Support Enforcement what time frame it takes for them to get it.
If the proper paperwork has been filled out, and if he has a refund coming, then it would be taken toward the amount owed to you.
It doesn’t matter where he got his taxes done, or whether he did them himself. It’s the IRS that does the taking, and no matter how his return was done, it would end up there.

it doesnt matter where he files it, if he owes a certain amount of child support arrears (and its listed as a tax refund intercept), they’ ll snatch it and reissue it to you.
1) call your caseworker and ask if its been sumitted for a tax refund intercept yet. if not, when would it be…
also ask if its (the arrears) been reported on his credit reports yet.
if he OWES it to the government, you still get nothing. they will not give you a cut of what he owes them.
as for an arrears hearing, if no progress has been made on the arrears amount.
ALSO, if your caseworker (or dept) isnt on the ball, write your Regional Federal Child Support Office (link is below). dont forget, that you can also write your states Attorney General, Governor and State Child Support Office. ask them what they are doing about it. tell them you want leins, his drivers license suspended, etc.
if you hear nothing, FAX IT AGAIN. FAX it weekly if need be.
